Covid-19 threat, PIL filed to take away agitating farmers at Delhi borders

A lawyer has filed a public interest litigation (PIL) seeking a ban on large-scale rallies over concerns over the spread of Covid-19 as hundreds of farmers rallied in protest.

“Due to the collective gathering of protesters, the rate of spread of corona virus is likely to increase. Lawyer Om Prakash Parihar filed the PIL on behalf of petitioner, Rishabh Sharma, a law scholar.

“Most of the protesters are elderly and are at high risk of contracting this deadly virus. It is in their interest to stop such groups altogether,” the petition said. Farmers from Punjab, Haryana, Uttar Pradesh, Uttarakhand and other states are camping at different borders. They want to repeal the three agrarian reform laws.

The petition said that due to protests and closed border issues, vehicle movement would be affected and those coming to and from Delhi for medical treatment would be further affected. “Given the current situation in Delhi, the number of Covid-19 cases is increasing, which makes the transportation of essential medicines more important, but this is not possible due to protests,” it said.

The police allowed a special place, the place where they were allowed to protest but did not seem to have changed. According to the Indian Penal Code, such actions are punishable under sections 269 and 270 of the IPC if there is a risk of infection or the development of such a fatal illness.

The petitioner prayed that the government would pave the way for the opening of all the borders of Delhi, “Provide mandamus or other appropriate instructions to the protesters and concerned authorities, use face masks to move the protesters to the designated place and provide guidance on social distance. ”
